1. Definition of Protected Assets


The digital artworks created by Lin Hsin Hsin and/or exhibited within this Virtual Museum are not static image files (eg JPG, PNG). They are the

visual manifestations of a proprietary,
top-secret computational engine


This engine comprises unique mathematical formulae, algorithms, cryptographic information and code-to-image processes developed by Lin.Hsin Hsin. Under Singapore law and international intellectual property standards, these underlying processes constitute


strictly protected Trade Secrets


Their economic value is derived exclusively from their confidentiality and non-public status.



2. Legal Framework: Singapore Jurisdiction


Protection of these assets is governed by the Singapore Common Law of Confidence and the Computer Misuse Act 1993.



📍 Breach of Confidence



Pursuant to the landmark Court of Appeal decision in I-Admin (Singapore) Pte Ltd v Hong Ying Ting [2020] SGCA 32, the mere unauthorized possession, access, or circulation of confidential digital materials constitutes a breach of confidence. It is not necessary to prove that the information was used for commercial gain; the wrongful loss of secrecy itself is the actionable harm



📍 Computer Misuse Act



Any unauthorized copying, moving, or uploading of any digital assets created by the founder of Lin Hsin Hsin Art Museum to an external server or public cloud constitutes an offense under

⭕️ Section 5 Unauthorized Modification


of the Computer Misuse Act, carrying potential criminal penalties including fines and imprisonment



3. Prohibited Conduct & Misappropriation


The Museum maintains a zero-tolerance policy regarding the handling of the manifestations of the proprietary computational engine


⭕️ Improper Means


Any directive, coercion, or force exerted by any third party -- including clients, partners, or State-Owned Enterprises— to upload, transfer, or store the creator or the Museum’s proprietary algorithms or source code on any public, unencrypted, or third-party cloud server is classified as Misappropriation by Improper Means.


⭕️ Invalidation of Consent


Consent obtained under duress or coercion is legally void. Such acts are treated as theft by duress and unauthorized exfiltration of trade secrets.


⭕️ Destructive Disclosure


Uploading these assets to a public cloud environment without Lin’s explicit, written security protocols constitutes a destructive disclosure that irreparably harms the asset's value.
