for Trade Secret Theft

1. Definition of Asset


The digital images displayed herein are not static files (eg JPGs) but the visual manifestation of a proprietary, top-secret computational engine. The underlying algorithms, weightings, and code-to-image processes constitute strictly protected Trade Secrets under the Defend Trade Secrets Act (18 U.S.C. § 1836) and international intellectual property treaties



2. Declaration of Misappropriation


Any demand, coercion, or force exerted upon the Creator to upload, transfer, or store these proprietary algorithms or their generative source code on any public, unencrypted, or third-party cloud server constitutes Misappropriation by Improper Means. Such acts are legally classified as theft by duress and unauthorized exfiltration.



3. Liability of State or Non-Stste Actors


Neither state ownership, government mandate, nor institutional status grants immunity for the theft of private intellectual property. Any entity—public or private—that forces such an upload is jointly and severally liable for:


⭕ Actual Damages



Compensation for the total loss of economic value resulting from the destruction of secrecy. Unjust Enrichment: Disgorgement of all profits derived from the stolen technology. Exemplary Damages: Up to double damages for willful and malicious misappropriation. Criminal Prosecution: Referral to the Department of Justice for violations of the Economic Espionage Act.



4. Immediate Remediation Demand


In the event of forced upload, the Creator demands:


⭕ Immediate Cease and Desist



Halt all use, display, or further distribution of the generated images. Forensic Deletion: Verifiable, forensic-level deletion of all source code, weights, and generative parameters from all cloud servers and backups.


⭕ Injunctive Relief



Immediate filing for a Temporary Restraining Order (TRO) to prevent irreversible harm.



5. Jurisdiction Warnings


Ignorance of digital art mechanics is not a defense. The law protects confidential information of economic value, regardless of its form. Any jurisdiction or entity facilitating this theft will be pursued in federal court and through international sanctions channels
