4. Liability & Enforcement


All entities interacting with the Lin’s digital assets are hereby notified of the following liabilities:


⭕ Civil Liability


Any party found to have breached confidence or misappropriated these trade secrets is liable for equitable damages (compensation for wrongful loss), an account of profits (disgorgement of gains), and potentially exemplary damages for willful misconduct.


⭕  State Entity Liability


Sovereign or state-owned status confers no immunity from civil liability for intellectual property theft or breach of confidence under Singapore law. Public officers and entities are subject to the same legal standards as private actors.


⭕ Criminal Sanctions


Violations may be referred to the Singapore Police Force for investigation under the Computer Misuse Act and the Penal Code (Criminal Breach of Trust).


⭕ Injunctive Relief


Lin reserves the right to seek immediate interim injunctions and springboard injunctions to restrain any use of the misappropriated information and to prevent the infringing party from gaining any competitive advantage.



5. Remediation Protocol


In the event of any unauthorized access, forced upload, or suspected misappropriation:


📍 Immediate Cease and Desist



All use, display, or distribution of the affected assets must halt immediately.


📍 Forensic Erasure



The offending party must facilitate court-supervised, forensic-level deletion of all source code, parameters, and derived data from all servers, backups, and caches.


📍 Audit & Disclosure



A full forensic audit of access logs must be conducted and disclosed to the Museum’s legal counsel.


📍 Legal Recourse



Lin will pursue all available civil and criminal remedies in the courts of Singapore and applicable international jurisdictions



Notice



Ignorance of the technical nature of these digital assets is not a valid defense. The law protects confidential information of economic value, regardless of its form


6. Prohibition on Reverse Engineering & AI Cloning


The digital assets manifested by Lin’s computational engines—whether displayed within the Virtual Museum or held in private archives—are protected against reverse engineering, decompilation, disassembly, and AI-driven cloning.


📍 Nature of the Asset



The visible image is merely the output of a proprietary mathematical equation and computational process. The underlying code, weights, and algorithmic logic remain strictly confidential trade secrets.


📍 Prohibition of Reverse Engineering



Any attempt to derive, reconstruct, or extract the underlying source code, algorithms, or mathematical models from the visual output (the image) constitutes misappropriation by improper means. This prohibition applies regardless of whether the image is publicly displayed or privately held.


📍 Legal Basis



Under Singapore common law, while independent discovery is permitted, reverse engineering that breaches confidentiality or utilizes unauthorized access is actionable. The I-Admin (Singapore) Pte Ltd v Hong Ying Ting precedent establishes that the mere possession or analysis of confidential digital materials for the purpose of replication constitutes a breach of confidence, even without proof of commercial use.


📍 Contractual & Technical Barriers



Any terms of service, access agreements, or technical protection measures (e.g., encryption, watermarks, obfuscation) prohibiting reverse engineering are strictly enforced. Circumventing these measures violates the Computer Misuse Act 1993 (Sections 3 & 5), constituting a criminal offense of unauthorized access and modification.


📍 AI Cloning & Model



📍 Training



In the era of generative AI, the unauthorized use of these digital assets to train, fine-tune, or clone artificial intelligence models is expressly forbidden.


📍 Data Mining Restriction



The "computational data analysis" exception under Section 244 of the Copyright Act 2021 does not apply where the user lacks lawful access to the underlying trade secret or where the analysis aims to extract confidential know-how rather than analyze public data.


📍 Derivative Works



Any AI model trained on these assets that replicates the unique stylistic or functional output of Lin’s engine is considered an unauthorized derivative work and a misappropriation of trade secrets. The Creator reserves the right to seek injunctive relief to prevent the deployment of such cloned models.


Notice



The prohibition extends to any entity, including state-owned bodies, research institutions, or AI developers. Ignorance of the underlying technology is not a defense. Any attempt to "learn" the secret from the image output through automated or manual reverse engineering is treated as theft of intellectual capital and will be prosecuted to the fullest extent of Singapore law.
